1. Introduction & acceptance

These Terms of Service (the “Terms”) form a binding agreement between you and YOGI 108 FL LLC(“Yogi108,” “we,” “us,” or “our”) and govern your access to and use of our website at yogi108.shop, as well as any purchase of products from us. By browsing the site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site or purchase our products.

3. Eligibility

You must be at least 18 years of age and able to form a legally binding contract to purchase products from us. By placing an order you represent and warrant that you meet these requirements and that the information you provide is accurate and complete. Products may be used by minors only under the direct supervision of a responsible adult.

4. Products & pricing

We sell physical yoga and movement apparatus. We make reasonable efforts to describe and photograph our products accurately; however, colors, finishes, materials, and dimensions may vary slightly from what is shown on your screen, and minor variations between units are normal for hand-finished goods.

• All prices are stated in USD and exclude any taxes, duties, or shipping charges unless expressly stated otherwise.
• We may change prices, descriptions, and availability at any time without notice.
• Despite our best efforts, products may occasionally be mispriced or described in error. We reserve the right to correct any errors and to cancel or refuse any order placed at an incorrect price, even after an order has been confirmed; in that case we will notify you and issue a full refund of any amount charged.

5. Orders & acceptance

Your submission of an order is an offer to purchase. All orders are subject to acceptance by us. An order confirmation email acknowledges receipt of your order but does not by itself constitute acceptance; a contract of sale is formed only when we dispatch the products or otherwise confirm acceptance. We may decline or cancel an order for reasons including product unavailability, suspected fraud, pricing errors, or inability to verify your details, and will refund any amount paid for a cancelled order.

6. Payment

Payments are processed securely on our behalf by third-party payment providers, Stripe and PayPal. We do not collect, process, or store your full card number or other sensitive payment credentials on our systems; that data is handled directly by the payment provider under its own terms and security standards. Your bank or card statement will show the descriptor YOGI108 GEAR. You authorize us and our payment providers to charge your selected payment method for the total amount of your order, including applicable taxes and shipping.

7. Shipping

We ship our products internationally. Delivery times, methods, costs, and any free-shipping threshold (currently orders of 80 USD and above) are described on our Shipping page. Title and risk of loss for products pass to you upon delivery to the carrier, except where a mandatory consumer-protection law provides otherwise.

8. Returns & refunds

You may be entitled to return certain products and receive a refund as set out in our Refund & Return Policy. Please note that, for health and hygiene reasons, certain skin-contact items are not returnable once opened unless they are faulty. The Refund & Return Policy is incorporated into these Terms by reference.

9. Assumption of risk

Our products include advanced apparatus intended to support yoga and movement practice, such as equipment used for inversions, backbends, headstands, and other load-bearing positions. Physical activity of this kind carries an inherent risk of serious injury, including but not limited to falls, strains, and impact injuries. You knowingly and voluntarily assume all risks associated with the purchase and use of our products.

• Use each product only within your own trained ability and range of motion, and progress gradually.
• Set up and use equipment on a stable, level surface with adequate clear space around you.
• Seek qualified, in-person instruction before attempting advanced poses, and stop immediately if you feel pain, dizziness, or discomfort.
• Inspect hardware and load-bearing components before each use and observe each product’s stated maximum load and instructions.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, our products and the site are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. Where permitted by law, we disclaim all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under the law applicable to you; mandatory consumer rights remain unaffected.

11. Limitation of liability

To the maximum extent permitted by applicable law, YOGI 108 FL LLC, its owners, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of the site or products, even if advised of the possibility of such damages. To the extent permitted by law, our total aggregate liability arising out of or related to these Terms or any product will not exceed the amount you actually paid to us for the product giving rise to the claim. These limitations do not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence where such limitation is prohibited.

12. Indemnification

You agree to indemnify, defend, and hold harmless YOGI 108 FL LLC and its owners, officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of a product, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Intellectual property

All content on the site, including text, graphics, logos, product images, and the Yogi108 name and marks, is owned by or licensed to YOGI 108 FL LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the site for your personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

14. Prohibited uses

You agree not to:

• use the site for any unlawful, fraudulent, or harmful purpose, or in breach of these Terms;
• attempt to gain unauthorized access to the site, its systems, or other users’ accounts;
• interfere with, disrupt, or place an unreasonable load on the site or its infrastructure;
• use automated means to scrape, harvest, or collect data from the site without our permission;
• resell, misrepresent, or use our products in a manner inconsistent with their stated instructions and load limits.

15. Governing law & dispute resolution

These Terms and any dispute arising out of or relating to them or our products are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You and we agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any dispute, subject to any mandatory rights you may have under the consumer-protection laws of your place of residence.

Informal resolution first. Before commencing any formal proceeding, you agree to first contact us using the details in the Contact section and to attempt in good faith to resolve the matter informally. We will do the same. Most concerns can be resolved quickly and amicably this way.

16. Changes to these Terms

We may update these Terms from time to time to reflect changes in our products, the law, or our practices. When we do, we will revise the “Effective” date above and post the updated Terms on this page. Material changes will take effect on the date posted; your continued use of the site or purchase of products after that date constitutes acceptance of the updated Terms.
